Gameplay Telemetry Policy Mortal Shell 2 — Optional Gameplay Data Sharing 1. Introduction, who we are and how to contact us This policy explains what happens if you choose to turn on optional gameplay data sharing ("gameplay telemetry") in Mortal Shell 2 (the "Game"). Gameplay telemetry is off by default. Nothing described in this policy is collected unless you switch it on, and you can switch it off again at any time in the Game’s settings. We are Playstack Ltd, a company registered in England at 56A Poland Street, London, W1F 7NN, United Kingdom (company number 10168633), and we are the data controller for the data described in this policy. We are registered with the Information Commissioner’s Office (ICO) in the United Kingdom. The Game is developed by Cold Symmetry, Inc. PO Box 552, 440 NE 5th Av Camas, WA, 98607, which operates the telemetry service on our behalf. If you have questions about this policy or want to exercise your legal data protection rights, contact our data privacy manager at [email protected]. Changes to this policy We may update this policy to reflect changes to the telemetry system. If we make significant changes, we will flag them in the Game and, where appropriate, ask for your consent again before continuing to collect data. Children The Game is rated for mature audiences and as such, is only accessible once the relevant platform’s age gating conditions have been met. The optional telemetry feature is presented as part of the Game’s settings 2. What information will you collect about me and why? What we collect When gameplay telemetry is on, the Game sends us small event records describing how you play. Each record can include: • A pseudonymous player identifier. The first time you run the Game, it generates a random identifier on your device which has no connection to your personal accounts, your hardware, or any other service, and which cannot be derived from any of them. That random value is the only identifier attached to your telemetry records, so the stored data identifies you pseudonymously and cannot be used to look you up by name or account. • Session and build information. A random session identifier, the date and time of each event, the version of the Game you are playing, and your platform family (for example, Windows or Linux). We do not collect your hardware specifications. • Gameplay events. In-game deaths (including what defeated you and where in the game world it happened), boss encounters (which boss, how many attempts, fight duration, the abilities and weapons that dealt damage, and the outcome), the named game areas you enter and leave and how long you spend there, and periodic samples of your character’s position in the game world. • Progression measures. Your character level, weapon upgrade levels, total time played, cumulative in-game currency earned, and difficulty-related settings active at the time (for example, optional challenge modifiers). All positions and locations in these records are coordinates inside the fictional game world. We do not collect your real-world location, and the telemetry system does not access your device’s location services. Your IP address is used transiently by our servers to receive the data you send, as with any internet service, but it is not stored in or linked to your gameplay records and is promptly and securely deleted after this transient use. Why we use it, and our legal basis We use this data to understand how the Game is actually played — for example, where players die most often, which bosses are too hard or too easy, which weapons are underused, and how long areas take — so the development team can fix bugs and balance the Game. We only use it for game development and quality purposes. Our legal basis is your consent (the opt-in). You can withdraw consent at any time by turning gameplay data sharing off in the Game’s settings; collection stops immediately. Withdrawing consent never affects your ability to play the Game, and it does not affect the lawfulness of processing before you withdrew. Aggregated data We also produce aggregated statistics from this data (for example, "40% of players defeated this boss on their first attempt"). Aggregated data does not identify you and is not personal data; we may retain and use it indefinitely, including in public communications about the Game. What we do not collect The telemetry system does not collect your name, email address, contact details, payment information, friends lists, chat or voice content, files on your device, data from other applications, or any special category (sensitive) data or any other data that identifies you as a living individual (other than the transient use of your IP address as described above). It does not use cookies and the data is not used for marketing, advertising or profiling for commercial purposes. 3. Data sharing Your telemetry data is accessible to the Game’s development team at Cold Symmetry, Inc. and to relevant staff at Playstack, in each case only for the development and quality purposes above. The data is hosted on an infrastructure provider, Railway Corp, acting as our data processor under contractual obligations to protect it. We do not sell this data, share it with advertisers, or share it with any other third party for their own purposes. As set out in the main Playstack Privacy Policy, we may disclose data where we are required to by law or where disclosure is necessary to protect our legal rights or those of others. 4. Overseas transfers The telemetry service is hosted in the United States. Where your personal data is transferred outside the UK or the European Economic Area, we ensure appropriate safeguards are in place, such as contracts incorporating standard contractual clauses approved by the applicable regulators. We only hold your IP address on a transient basis to link to your pseudonymous identifier. After this, it is securely deleted. We keep game play telemetry records only as long as they are useful for developing and improving the Game. Aggregated, anonymous statistics and data which is not personal data may be kept indefinitely. If you ask us to delete your personal data (see section 7), we will also remove your records from our systems and exclude them from future processing. 6. Security Gameplay telemetry data is encrypted in transit between the Game and our servers. Access to the stored data is restricted to authorized members of the development and publishing teams, is authenticated, and is granted at the lowest level each person needs, with separate read-only and administrative credentials. The Game does not collect your platform account identifier, and only uses the pseudonymous identified defined in section 2. We regularly review these measures, and we have procedures in place to deal with any suspected personal data breach. 7. Your legal rights You have the same legal rights over this data as described in the main Playstack Privacy Policy, including: Right to withdraw consent. Turn gameplay data sharing off in the Game’s settings at any time. Collection stops immediately, and anything already recorded but not yet sent is discarded rather than transmitted. Right of access. You can ask us what telemetry data we hold about you and request a copy. Right to erasure. You can ask us to delete the telemetry data associated with your identifier. Rights to correction, restriction, objection and portability, as described in the main policy and applicable law. We will respond to all legitimate requests within the statutory time. 8.
